System Outages, Interim Measures and Issuance of ACI AMPS Penalties to Highway Carriers

CBSA has issued Customs Notice CN17-19 to accommodate carriers who haven't complied with their ACI eManifest requirements.  CBSA will allow carriers to return to the United States to comply with their eManifest requirements without being subject to an AMPS Penalty.  Carriers who decide to proceed without complying with their ACI eManifest requirements may be subject to AMPS penalties.  Please note: The provisions of this custom notice are only valid until midnight of August 26, 2017. 

Carriers who arrive at the border without complying with their eManifest requirements may need to determine why the incident occurred so they address any gaps in their training, systems or procedures.  CBSA also suggests carriers develop a contingency plan to address customs outages and delays.  Carriers who use the CBSA ACI Portal should also sign up for ACI eManifest service that uses EDI standards so they have another option to submit their eManifest declarations.

Carriers who submit their eManifest declarations using EDI standards should note one advantage of using EDI is during system outages or processing delays messages are queued up for processing once the CBSA systems are restored. This will allow carriers to continue to submit their declarations independent of whether the customs system is processing declarations or whether the ACI Portal is working. 

Please note our eManifest service uses EDI standards and also has the capability of sending users email messages that are triggered when we receive customs EDI messages.  This option may offer carrier's an operational advantage over other EDI systems particularly when CBSA's systems may be down or slow.
