ACE Truck Manifest Section 321 Declaration Requirements

U.S. Customs and Border Protection announced in message CSMS# 18-000656 that carriers declaring their cargo using the ACE truck manifest would be required to declare all of their Section 321 declarations.  CBP is changing their policy which exempted the requirement for carriers to submit electronic Section 321 declarations due to their significant growth and their challenges of conducting risk assessments through their Automated Targeting System.  CBP will begin a phased approach for non-compliance commencing on November 26, 2018.  On January 1, 2019 carriers who make not attempt to comply with the requirement will be subject to customs penalties. 

CBP has provided additional clarification and contact information in message CSMS# 18-000659 stating all commercial truck shipments containing low value merchandise under the provisions of 19 CFR 10.151 will require an advanced electronic manifest to be filed with CBP Prior to crossing the border. 

Carriers or couriers can electronically declare their section 321 declarations through the ACE Portal, through EDI declarations or by using a service provider.  Carriers using the eManifest Express software can already declare their section 321 shipments.  If you require a solution please contact us or subscribe to our service.
